EXPRESSFLY™ Terms of Service

Account Terms

• You must be at least 18 years old to use the EXPRESSFLY™ Service.
• You agree to provide accurate and complete information including your full legal name, valid email address, current address, and any other necessary signup details.
• You are solely responsible for maintaining the confidentiality of your account credentials. EXPRESSFLY™ is not responsible for any loss or damage due to unauthorized access resulting from your failure to safeguard your credentials.
• You may not use EXPRESSFLY™ for any unlawful or unauthorized purposes. You must comply with all applicable Indian laws, including copyright and data protection regulations.
• You are responsible for all activity and content (data, graphics, photos, links) uploaded under your EXPRESSFLY™ account.
• You must not upload or transmit any worms, viruses, or malicious code.
• Any breach of these terms may result in immediate termination of your services, at the sole discretion of EXPRESSFLY™.

General Conditions

You must read and accept these Terms of Service along with our Privacy Policy before using the EXPRESSFLY™ Service.

• We reserve the right to modify or terminate the Service at any time without notice.
• We may refuse service to anyone for any reason at any time.
• The Service is provided "as is" and "as available" without warranties of any kind.
• We do not guarantee that the service will be uninterrupted, timely, secure, or error-free.
• We do not warrant the accuracy or reliability of any results obtained through the Service.
• Your content (excluding payment information) may be transferred unencrypted across various networks to adapt to technical requirements.
• We reserve the right to remove any content or accounts we determine as unlawful, offensive, threatening, defamatory, obscene, or otherwise in violation of these Terms or intellectual property laws.
• EXPRESSFLY™ is not liable for any damages arising from the use or inability to use the Service.
• You agree to indemnify EXPRESSFLY™, its affiliates, and employees against any claims arising from your breach of these Terms or violation of any law or third-party rights.
• Technical support is only provided to paying users via email or pre-agreed support channels.
• You agree not to reproduce, duplicate, copy, sell, or exploit any part of the Service without EXPRESSFLY™'s written permission.
• Verbal or written abuse of any EXPRESSFLY™ user or staff will lead to immediate account termination.
• You retain ownership of your content, but grant EXPRESSFLY™ permission to store, display, and review it as needed to operate the Service.
• Failure by EXPRESSFLY™ to enforce any provision of these Terms shall not be considered a waiver of those rights.
• You may not use EXPRESSFLY™ trademarks in domains or ads without permission.

Payment of Fees

• Payments may be monthly, quarterly, half-yearly, or annually, depending on your agreement with EXPRESSFLY™.
• Invoices must be paid within 7 days of issuance. Late payment may result in service suspension or termination.
• All fees are exclusive of applicable state and central taxes.
• EXPRESSFLY™ does not offer refunds under any circumstance.

Cancellation and Termination

• Upon cancellation, all data and content will be permanently deleted. This action is irreversible.
• We reserve the right to suspend or terminate your account at any time, for any reason, without notice.
• If fraudulent activity is suspected, EXPRESSFLY™ may immediately terminate your account.

Modifications to the Service and Pricing

• Pricing may change with 14 days' notice, either posted on our website or via email.
• EXPRESSFLY™ reserves the right to modify or discontinue any part of the Service without prior notice.
• We are not liable for changes in pricing, features, or availability of the Service.

Restricted Products and Services

You may not list, sell, or promote any products or services that are illegal or restricted under Indian law. EXPRESSFLY™ strictly prohibits the following:

• Securities as defined by the Securities Contract Regulation Act, 1956
• Live or dead animals, animal parts (e.g., skins, antlers, eggs) restricted under the Wildlife Protection Act, 1972
• Weapons, firearms, or ammunition
• Alcohol, tobacco, narcotics, and similar controlled substances
• Religious items that may offend religious sentiments
• Antiquities and art treasures restricted under the Antiquities and Art Treasures Act, 1972
• Used SIM cards

Additionally, you must display a Terms of Use and Privacy Policy on your store in compliance with applicable laws and ethical standards.
